Consequences of Abolishing Capital Punishment

Let us first get to know what Capital Punishment is. This is a punishment given by the Top Legal authorities of the country to the victims who had been punished for certain grave sins and gone through the legal battle in all ordinary courses. Based on the gravity of the crime committed he can be awarded this punishment which is known as capital punishment. The same is also mentioned as death penalty and it is also known as Head Punishment. In such references and verdicts given by the Judiciary systems, the prisoner would be given this punishment and also hanged to death. In others words he would be executed. This can be given to Criminals, Terrorists, Religious Dissidents and it depends on the density of the crime, which becomes very grave and not compatible by the rule of law.

The same punishment is slowly becoming to extinct from the states. There are over 50 countries are practising such Punishments and there has been a regular sound created by the Amnesty International to withdraw Capital Punishment from the rule of Law. For which every country has been advised and get away with such ruling and instead try out other source of punishments to the doers of such crime and which are intimidating and a grave offence causing the citizens of innocent public. More than 75% of executions are done in Asian countries today. The UNO has indicated through their resolution done in various years and with specific reference to its resolution done in 2010 to have moratorium on Capital Punishments and almost all the countries have been informed and resist from such practises. However, like India, China is still in the practise of such punishments being awarded by their judiciary. Such Punishments are awarded to acts of Treason, Criminal Conspiracy to turn a Government, to abet the Religious sentiments of a society and causing dangerous crimes by killing Religious heads and murder. In the military, there have been such punishments too to those who do act of cowardice, desertion, espionage, mutiny etc.images (1)

Of course there has been a continuous cry in the UN to abolish the same and in alter the victims could be awarded life sentences which means to stay that they have to stay in the Prison till their life. Let us go into the consequences of abolishing the Capital Punishment and the effect on the society and the criminals. However, our Indian Government is committed to retain the capital Punishment and they are absolutely against the same.

The Primary benefit would be the cost of the entire Judicial spending on the criminal, his safety and conducting the proceedings in the lower courts. The appeals heard and relevant witnesses are countered for argument of the case. If the prisoner is of a foreign dissent, we need to secure, his life during the entire trial and his safety becomes primary and which is huge in adopting all the safety measures. Bilateral permissions and conditions have to be observed as per agreement and proper counselling arrangements for him to have a compassionate hearing. I can visualise you with an example of the case of Ajmal Kasab who was involved in the freak killings of the innocents in Mumbai in Taj Hotel who was a Pakistan Militant. You would better appreciate the monumental procedural climate of our country when we had heard him during the trial and consequent punishment awarded on him after a long process. Of course, when we take into account of the last year Delhi rape victims who are all teenagers (five of them) has to be met the capital punishment for Nirbaya a young girl raped and thrown to death after the Bus incident? The punishment of Death has been very fitting and right. If they are let free and less punishment is awarded means they would be inclined to go ahead with such crimes and after all the punishment is not going to be big and effective. It would be a revelation for all the other persons in life to have a go and try out on such punishments. There will not be a fear of doing the same. How many such cases of rapes have been reported in the news, you turn in day in and day out there is a Colum which goes to say that there has been a rape of an young woman, or a mother, or even grown up ladies are countered with such attacks. There have been cases of murders of innocent men and women for money, the valuables they are wearing on their self and the houses are looted and create havocs in their life.capital-punishment

 

To make a conclusion and sum it up the awardees of capital punishment after due legal proceedings and relevant expenditure on the affidavits and defendants there has been a stay of so many factors for the aggrieved. The families who have been affected by the grave incidents and their loss of monetary wealth and tarnished family images, which had gone beyond books and each one of them, are suffering a hell due to this aftermath. The surviving rape victims in many cities are put to all hardship in their dwelling and in the society, all of whom are finding ways to break even from the mental loss as well as financial outbreak in their families. Who are going to take care of them and at what cost, the question is very big and they have been forced to suffer on account of the misery in their family. Some victims are benefited after such accidents and some are uncared and put to the corner without any one coming into their rescue at all.capital_punishment01

 

Hence, abolishing the death penalty is the Government to decide, the abdicated and their families are at loss, which is obvious.
